TERMS OF USE

Fase Uno Srl company (hereinafter simply Fase Uno or Seller) markets clothing items for children.

Fase Uno has created a remote sales network through the website www.childrenluxuryoutlet.com governed by these General Conditions of Sale.

The conditions of sale applicable to orders placed through the website www.childrenluxuryoutlet.com are those in force at the time of purchase. Fase Uno reserves the right to update them at any time.

Before placing the order, the Customer will be asked to confirm that he / she understands and accepts the Conditions of sale in force at the time the order is sent, in case of refusal of the Conditions of sale, it will not be possible to order any Fase Uno product from the site. Those who intend to use the website will be deemed, by virtue of the use made, to have accepted to be bound by the Fase Uno Privacy Policy which is to be considered an integral part of these Terms of Sale.   1. Commercial policy

Only consumers who purchase for purposes other than re-selling, can place orders on the website. It is strictly forbidden to resell items bought on www.childrenluxuryoutlet.com.

Orders may be placed only by consumers who: (a) are at least 18 years old, (b) are legally capable of entering into binding contracts. If you are under the age of 18 and are not legally capable of entering a binding contract, a parent or legal guardian will carry out the order and accept our Terms and Conditions of Sale posted on www.monnalisa.com. Any order made in violation of this provision shall be null.

ARTICLES

Each item is represented by a photograph and is accompanied by a "product sheet" which contains the following information: a) brief description, b) colors and sizes available, c) price d) general description.

The general description consists of a short description that shows some characteristics of the product. It is also possible to use fancy terms and in any case not referable directly to the product. The compositions of fabrics and materials are those shown on the labels of the products on sale.

Colors and sizes are shown for purely descriptive purposes; the color reproduction in particular may not be faithful to reality as the color reproduction depends on several elements: technical factors such as the customer's video resolution, the difficult reproducibility due to the composition material of the product etc.

Although Fase Uno makes every effort to ensure that the photos of the products correspond to the original products, there may be differences between the images and the products due essentially to technical reasons due to the Internet browser and monitor used.

The Terms of Use do not govern the supply of services or the sale of products performed by third parties other than the Seller. Before submitting orders and purchasing products and services from third parties, we recommend to verify their Conditions of sale because the Vendor shall under no circumstances be deemed liable for the supply of services provided by third parties or for the execution of e-commerce transactions between the users of monnalisa.com and third parties.

  1. Placing an order

Before proceeding with a purchase, and with the transmission of the order form, the customer will be request to carefully read these Terms of Use, to confirm the global and binding acceptance of the Terms of Use and the Privacy Policy of the website. Once the customer has expressed his acceptance, he can proceed with the purchase by selecting the confirmation button, as indicated on the site.

  1. a) Product Selection

For each product selected on the site, a page will automatically open containing information relating to the product itself. The selection is made through the choice of color, size and subsequent "click" on the "buy" button. The "cart" can contain multiple products and can be changed at any time before the "order confirmation";

  1. b) personal informations

Upon confirmation of the order, the customer will be required to provide personal information, including the shipping address, tax code and payment details. The Customer guarantees that all personal information provided are true and correct.

  1. c) Acceptance of terms of sale and privacy

Once the order has been carefully checked and any necessary changes and corrections have been made, the customer will be asked to confirm the global and binding acceptance of these Terms of Sale. Once their acceptance has been expressed, the Customer can proceed with the purchase by clicking on the confirmation button, as indicated on the site.On monnalisa.com only products designed by Monnalisa sold and purchased directly from Monnalisa S.p.A.– with its head office at Madame Curie, 7, 52100, Arezzo (Italy).

 

  1. d) Prices and payments

The main characteristics of the products are presented on monnalisa.com in each product page and contains the following information: a) brief description, b) colors and sizes available, c) price, d) general description.

The pictures and colors of the products offered for sale on monnalisa.com may however not correspond to the real ones due to the Internet browser and screen used.

The Seller, in case of a return request, has the right to decline the products that are not supplied with the related tag or that have been altered in their essential and qualitative characteristics or that have been damaged.

The Customer can choose between the following payment methods:

- CREDIT CARD;

- PAYPAL;

- BANK TRANSFER; IBAN IT20M0846941630000000044240

- E-WALLETS

In the case of payment by credit card, the financial information (card number, expiration date, CVV) will be forwarded via encrypted protocol to Unicredit or other credit institutions that provide the related remote electronic payment services. This information will not be used by the Seller except to complete the procedures relating to the purchase and to issue the related refunds in case of exercise of the right of withdrawal.

In case of payment through the PayPal site, the Customer is invited to follow the procedures on the relevant site.

In case of bank transfer, the Customer must make a transfer to the bank details found in the section of the site in the part where the payment methods are specified. Proof of payment is given by crediting the amount of the transfer to the Seller's account. The Seller reserves the right to accept as proof of payment the transmission of the transfer coupon, received by e-mail at [email protected]. In the absence of credit within 10 days of order confirmation, the system will proceed with the cancellation.

The order form will be filed in the Fase Uno database for the period of time necessary to process the orders and in any case in accordance with the law.

  1. e) Order acceptance

The seller reserves the right to refuse the order, if the customer has not complied with the purchase procedure, has not accepted the General Conditions of Sale or if he does not provide all the data required for shipping and invoicing or in any case if the payment is not successful, i.e. in case of selection of the Credit Card mode, the bank has not authorized the debit on the Customer's credit card, in case of selection of bank transfer, the amount is not credited within ( 3) working days from the date of transmission of the order confirmation to the Seller's current account, in case of selection of the Pay Pal method, the credit to the Seller's account has not been correctly credited.

The total amount includes the sum of the sales prices and transport costs, depending on the delivery method selected by the Customer, and / or present on the site.

Any customs clearance costs and all taxes relating to the country of reference are excluded.

  1. f) Product availability

If the items offered for sale are no longer available or on sale at the time of the last access or no longer available when the order confirmation is sent, it will be the Seller's responsibility to promptly notify the Customer of any unavailability of the ordered products. In case of forwarding of the order confirmation and payment of the price, the seller will refund the amount already advanced by the Customer.

  1. g) Order Confirmation

By sending the Order Confirmation to the Seller electronically, the customer confirms his purchase and acceptance of these General Conditions of Sale.

The Order Confirmation will be filed in the Seller's database for the period of time necessary to process the orders and in any case in accordance with the law.

  1. h) Notice of receipt of orders and order confirmation

The sale is considered completed when the Customer receives confirmation from the Seller that his order has been accepted following verification of product availability and payment.

Upon confirmation of the order, Fase Uno will send the Customer, by e-mail, the links to the summary of the Conditions of Sale, information relating to the essential characteristics of the Products purchased, the price indication, information on the existence or less than the right of withdrawal, the address to which complaints can be lodged and existing commercial guarantees. The Customer must immediately check the content of the communication and immediately report any errors or omissions to the Seller. The order receipt notice will contain an order reference number attributed by Fase Uno. Once received, the customer is required to keep the Order Reference number for any inquiries on it.

The Customer expressly allows the information referred to in this article to be provided not on a support but by transmission via e-mail.

DIGITAL SECURITY

Fase Uno undertakes to protect the Customer's personal information for the entire online sales process. However, it is not possible to guarantee the security and integrity of the data transmitted to the website and therefore the seller cannot be held responsible for damage or loss resulting from the use of the internet, as in the case of hacking (illegal intrusion into computer systems).

 

To find out the specific shipping methods for the products, access the Shipping section. The indications contained in this section form an integral and substantial part of these General Sales Conditions and, therefore, they are considered fully known and accepted at the moment of the order. To be considered that the shipping and delivery terms indicated are approximate.

All shipments to countries outside the European Union, as requested by customs procedures, are accompanied by an official invoice stating the value of the individual items.

It is not possible to make changes to the order once it has been submitted.

Orders placed separately will be shipped separately.

In case of products "available in store", the shipment may be delayed for a few days due to the to the management of the goods at peripheral warehouses.

MONNALISA will do its best to ensure delivery with the courier within the delivery time specified in the order confirmation, but is not responsible for any delays due to customs operations and checks, or for reasons beyond its control.

Monnalisa may use SDA, DHL or UPS for the shippings.

In the order confirmation, the customer expressly accepts the delivery terms provided at art. 54 Consumer Code.

In all countries outside the European Union, shipments are made in DDP (Delivery Duty Paid), so all applicable import taxes are included in the final price of the product (there may be excluded countries due to their national regulation and the impossibility to apply the service). If, however, for some reason the delivery is refused or the customer becomes untraceable, the courier can return the items to Monnalisa.

If delivery is refused, the courier can abandon or return the items to Monnalisa.

In the event that the order is returned, Monnalisa may be required to pay the carrier additional costs in relation to the return costs including customs and import charges. Monnalisa will recover these costs from the customer, deducting the corresponding amount from any reimbursement due.

Furthermore, it is not possible to ship to PO boxes or postal codes without a specified address.

  1. Return policy

The Customer has the right to request a return within 14 (fourteen) days. The period expires after 14 days from the moment the Customer or a third party acquires physical possession of the goods.

To exercise the right of withdrawal, the Customer is required to inform Fase Uno of his decision to withdraw from this contract by means of an explicit declaration by e-mail to [email protected].

To meet the withdrawal deadline, it is sufficient for the Customer to send the communication relating to the exercise of the right of withdrawal before the withdrawal period has expired.

If the Customer withdraws from this contract, he will be reimbursed for all payments made to Fase Uno under the contract without undue delay and in any case no later than 14 days from the day on which Fase Uno receives the notice of withdrawal. These refunds will be made using a credit card, PayPal or bank transfer. The refund will be made based on the payment method selected by the Customer. In any case, the Customer will not have to incur any costs as a consequence of this reimbursement.

The Customer must return the goods at his own expense as indicated by Fase Uno, without undue delay and in any case within 14 days from the day on which he communicated his withdrawal from this contract. The deadline is met if the Customer sends back the goods before the expiry of the 14-day period. Shipping costs will be borne by the buyer.

The right of withdrawal is exercised correctly if the following conditions are fully met:

  1. a) Sending an e-mail as specified above;
  2. b) The products must not have been used or damaged.

The returned goods will be subjected to a quality control.

The products must be returned with tags and labels originally affixed, in perfect condition, new, unused and in their original packaging. The Customer will be held responsible for any lower value of the goods caused by handling other than that necessary to establish the nature and characteristics of the goods.

SHIPMENT

* Shipping cost - € 9 in Italy excluding the islands. - € 12 in Sicily, Sardinia - € 15 in Europe - € 18 UK.

Estimated delivery times to be considered from the date of shipment:

- Europe - European Union - 2-6 working days depending on the destinations

Fase Uno will do everything possible to ensure delivery with the courier within the delivery time specified in the order confirmation, but is not responsible for any delays due to customs operations and controls, or due to force majeure beyond its control.

Fase Uno can use DHL, BRT or TNT / FEDEX.

In the order confirmation, the Customer expressly accepts the delivery terms provided therein in derogation of the provisions of art. 54 of the Consumer Code.

If the delivery is refused, the courier can return the items in Fase Uno.

In the event that this happens, Fase Uno may be required to pay the courier additional costs in relation to the return costs; in this situation, Fase Uno will recover these costs from the customer, deducting the corresponding amount from any refund due.

INVOICES

Following the fulfillment of the order, Fase Uno will issue an invoice that will be delivered together with the product.

WARRANTY

The Customer is required to verify the correspondence of the Product received with the order placed. In the event that the Customer finds that the product does not comply with the order, he must contact Fase Uno in the manner provided for in Article 6 and arrange for the return of the item.

In this case, the provisions of Article 6 will be applied insofar as they are compatible

The legal guarantees provided for in articles 129 et seq. Apply to the sale of the Products. of the Consumer Code in the case of purchase of defective products. In the presence of a lack of conformity, the Customer has the right, at his choice, to the repair or replacement of the defective goods by the seller, without charge, unless the remedy requested is impossible or excessively expensive compared to the other. If replacement or repair is not possible, the consumer is still entitled to a price reduction or to have a sum, commensurate with the value of the goods, against the return of the defective product to the seller.

The legal guarantee lasts two years from the delivery of the goods and must be asserted by the consumer within two months from the discovery of the defect.

The Seller, having found the lack of conformity, must carry out the repair or replacement of the goods within a reasonable time from the request and without charging the consumer with expenses. For any complaints, please refer to the procedures set out in art. 13 of the Consumer Code.

Shipments are insured free of charge against theft and accidental damage.
